ACCEPTANCE OF TERMS
By accessing or using this Site in any way, you agree to and are bound by the terms and conditions set forth in this document and in any changes here to that MyNameIsBanks may publish from time to time (collectively, the "Terms of Use"). If you do not agree to all of the terms and conditions contained in the Terms of Use, do not access or use this Site.

Your access and use of the Site will be subject to the current version of the Terms of Use, rules and guidelines posted on the Site at the time of such use. If you breach any of the Terms of Use, your license to access or use this Site shall automatically terminate.
INTELLECTUAL PROPERTY; LIMITED LICENSE TO USERS
All images and other content on this Site (collectively the "Content"), as well as the selection and arrangement of the Content, are protected by copyright, trademark, patent, trade secret and other intellectual property laws and treaties (collectively, "Intellectual Property Laws"). Any unauthorized use of any Content may violate such laws and the Terms of Use. Except as expressly provided herein, MyNameIsBanks does not grant any express or implied permission to use any Content. You agree not to copy, republish, frame, link to, download, transmit, modify, adapt, create derivative works based on, rent, lease, loan, sell, assign, distribute, display, perform, license, sublicense or reverse engineer the Site or any or the Content. In addition, you agree not to use any data mining, robots or similar data and/or image gathering and extraction methods in connection with the Site or Content.
All other trademarks, product names, and company names or logos used or appearing on the MyNameIsBanks website are the property of their respective owners. Reference to any products, services, processes or other information, by trade name, trademark, manufacturer, supplier or otherwise does not constitute or imply endorsement, sponsorship or recommendation thereof by MyNameIsBanks, unless expressly so stated.
MYNAMEISBANKS LICENSE AGREEMENT
The Contents (“Contents”) including, art, music*, visual fx products, and graphics contained within the MyNameIsBanks website are copyrighted.
For the purposes of these Terms of Use, the term, "Trademark(s)" means all common law or registered trademarks, logos, service marks, trade names, Internet domain names, or other indications of origin now or in the future used by MyNameIsBanks.
You agree that you will not contest or otherwise challenge (e.g., in any legal action or otherwise), or assist or encourage any other person or entity to contest or challenge, the validity of any of MyNameIsBanks’ Trademarks or the Trademark rights claimed by MyNameIsBanks.
Nothing contained herein grants or shall be construed to grant you any rights to use any trademarks by MyNameIsBanks or its vendor or manufacturers, unless expressly conferred by these Terms of Use.
You agree that you will not use MyNameIsBanks' Trademarks in any manner that might tarnish, disparage, or reflect adversely on such Trademarks or MyNameIsBanks.
VFX Products:
By this Agreement, My Name Is Banks grants you a personal, non-exclusive, non-transferable, right to use, modify and reproduce the Contents by incorporating it into a derivative work such as a feature film, documentary, multimedia presentation, advertisement, live performance and/or internet website and displaying and/or distributing that derivative work to the public by any means now known or hereafter developed. Please read this agreement carefully before using the product. If you choose not to accept this agreement, you must return the product unused. By using any part of the Contents, you are agreeing to the following terms:
1. The Contents may only be used on only 1 computer at any one time.
2. You may not sell, redistribute, sublicense, loan, give, or transfer any part of the Contents or allow the Contents to be accessed by other individuals.
3. You may not use the Contents for distribution on stock footage websites, neither as individual
elements or part of a composite. You must accept the Contents "as is" with no express or implied
warranty.
4. The Contents may not be transferred to any third parties through networked computers.
5. You agree to indemnify and hold harmless Banks and My Name Is Banks and all of its officers, directors, employees and agents ("Those Indemnified") for any and all losses, damages, liabilities, claims, costs or expenses, including reasonable attorneys' fees, incurred directly or indirectly by
Those Indemnified in connection with the use of the Data for any unlawful, unauthorized or prohibited purpose.
6. The Contents may not be used in any promotion or exploitation involving any type of illegal affairs.
7. You may not use the Contents (in whole or in part) as a trademark, logo or an element thereof.
8. You cannot take the Content or superficially modify the Content and print it on a t-shirt, poster or other item, and sell it to others for consumption, reproduction or re-sale.
Refund Policy: ALL SALES FINAL!!!
Being that all products are downloadable, there is no refund, so please ensure that the product you are purchasing is the desired product before purchansing.
INDEMNIFICATION
You agree to defend, indemnify and hold harmless MyNameIsBanks, its subsidiaries, affiliates, licensors, employees, agents, third party information providers, Submitters and independent contractors against any claims, damages, costs, liabilities and expenses (including, but not limited to, reasonable attorneys' fees) arising out of or related to your conduct, your use or inability to use the MyNameIsBanks website, your breach or alleged breach of the Website Terms of Use or of any representation or warranty contained herein, your unauthorized use of the MyNameIsBanks products, or your violation of any rights of another.
*Select songs and mixtapes are not part of this license agreement. The usage of those songs may require additional rights.
